Checking Out Different Mediation Styles

Mediation isn’t a one-size-fits-all approach to dispute resolution. You should choose the mediation technique that you’re most comfortable with and that serves the parties’ interests better than other techniques. Many mediators hold strong opinions about which one of the following techniques is better or constitutes “real” mediation. They include:



  • Facilitative: Through the use of concessions and reciprocity, you help the parties give and take until they reach an agreement.



  • Transformative: You preside over a process whereby the parties use the dispute to develop a deeper understanding and appreciation of each other and the communication and problem-solving skills they need to resolve this and future disputes.



  • Evaluative: You analyze, or help the parties analyze, the strengths and weaknesses of each side’s case so they’re able to make a judgment call primarily based on a risk/benefit analysis.
